This service is hosted by Digital Auto Refi Co LLC d/b/a DARC AUTO (hereafter collectively referred to as “DARC AUTO,” “we,” “us,” or “our”). Please review the following terms of service (the “Terms”) concerning your use of and access to the DARC AUTO website located at www.digitalautorefi.com, and any products or services offered therefrom (collectively referred to as the “Services”). By accessing, using, or downloading any materials or content from DARC AUTO or via the Services, you agree to follow and be bound by these Terms, which constitute a legal agreement between you and us. If you do not agree with the Terms, you should not use the Services.

These Terms govern your use of the Website and Services. Your loan documents will contain the terms specific to that finance transaction.

Certain portions of the Website may be accessible without accepting these Terms. However, to access core Services, you must accept these Terms, the Website Privacy Policy, Gramm-Leach-Bliley Act Privacy Notice, and the e-SIGN Policy. Your use may be limited if you do not provide such consent.

You represent that you are at least the age of majority in your state and agree to provide accurate and complete information when using our Services. You may need to log into a secure portal and accept additional consents and disclosures. You are responsible for safeguarding your login credentials.

To the maximum extent permitted by law, we are not liable for unauthorized access, inaccuracies in data you provide, or use of your credentials by others.

 

2. Changes to the Terms

We may change these Terms at any time by posting the updated version. Updates take effect on the "Effective Date" noted above. Continued use of the Services after changes means you accept them.

 

3. Limited License to Use the Services

We grant you a limited, revocable, non-exclusive license for personal, non-commercial use of the Services. You may not misuse the Services or violate applicable laws. You must not:

• Copy, modify, distribute, or reverse engineer our Services;
   

• Interfere with system functionality or other users’ access;
   

• Use scraping or automation tools;
   

• Act fraudulently or impersonate others;
   

• Use Services in ways that cause harm or violate laws.
   

 

4. Auto Finance Request Services

DARC AUTO connects consumers with third-party lenders (“Participating Lenders”) to apply for vehicle refinance or lease buyout loans. DARC AUTO is not a lender and does not make credit decisions.

We use the information you provide to match you with lenders whose credit criteria you may meet. With your permission, we may obtain your consumer report to help facilitate a lender match. If you choose to proceed, you must consent to submit a formal credit application to a Participating Lender.

If approved, the Participating Lender will provide terms directly to you. We may also offer third-party ancillary products, but purchasing them is not required to use our Services. DARC AUTO does not guarantee:

• That you will receive an offer;
   

• That terms provided are the best available.
   

Lenders determine credit eligibility, terms, and documentation requirements independently.

You agree that lenders may share information about your application and loan decision with DARC AUTO. We retain records as required by law.

 

5. Termination of Use

You may stop using the Services at any time. We may suspend or terminate your access without notice if you violate the Terms. We may also modify or discontinue features at our discretion.

 

6. Intellectual Property

DARC AUTO or its licensors own all intellectual property in the Services, including designs, content, software, and trademarks. No rights are granted other than those explicitly listed. Unauthorized use, copying, or distribution is strictly prohibited.

 

7. Copyright Infringement

All rights, trademarks, and proprietary content remain the property of DARC AUTO or its licensors. You receive no ownership rights through your use of the Services.

 

8. No Agency Relationship

These Terms do not create an agency, joint venture, or partnership between you and DARC AUTO.

 

9. Disclaimer

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied. We do not warrant that the Services will be uninterrupted or error-free. You use the Services at your own risk. We are not liable for communication failures or delays outside our control.

 

10. Limitation of Liability

To the fullest extent permitted by law, DARC AUTO shall not be liable for indirect or consequential damages arising from your use of the Services. In no event will our total liability exceed $200, except in the case of indemnity or breach of contract obligations.

 

11. Severability

If any provision of these Terms is found unenforceable, it will be modified or severed to preserve enforceability to the fullest extent permitted.

 

12. Miscellaneous

These Terms, along with our Privacy Policy, e-SIGN Policy, and other consents, represent the entire agreement between you and DARC AUTO. You may not assign these Terms without our written consent.
